TERMS & CONDITIONS
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE APPLYING
These Terms & Conditions constitute a legally binding agreement between Cashfund India  (“Cashfund India”, “Company”, “we”, “our”, or “us”) and you (“Customer”, “User”, “You”, or “End User”).
By clicking on “I Agree” or “I Accept”, downloading, installing, accessing, or using the Platform or Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree with these Terms, please do not use the Platform or Services.
DEFINITIONS
“Application” or “App”
Means the mobile application developed and operated by Cashfund India to provide loan-related services to users.
“Lender”
Means any Bank, Non-Banking Financial Company (NBFC), or financial institution partnered with Cashfund India for processing and sanctioning loans through the Platform.
“Company”
Means Cashfund India , a company incorporated under the Companies Act, 2013, having its registered office at:
1689/121, Shanti Nagar, Tri Nagar,
New Delhi, North West Delhi, Delhi – 110035.
“Customer” / “You” / “End User”
Means any person who accesses, downloads, uses, or interacts with the Platform or Services.
“Loan”
Means any financial assistance or credit facility applied for through the Platform and sanctioned by the Lender.
“Loan Agreement”
Means the agreement executed between the Customer and the Lender in electronic or physical form governing the terms of the Loan.
“Online Store”
Means Google Play Store, Apple App Store, Windows Store, or any other platform from which the App is downloaded.
“Outstanding Amount”
Means the total amount payable by the Customer including principal, interest, charges, penalties, and other dues.
“Platform”
Means the Website and Mobile Application collectively.
“Services”
Means the services provided through the Platform for loan application, verification, processing, and related activities.
“Third Party Platforms”
Means external platforms such as Facebook, LinkedIn, Google, or other integrated services.
“User Data”
Means all information, documents, and materials submitted by the Customer through the Platform.
“Website”
Means the official website of Cashfund India:
www.cashfundindie.in
SERVICES
Through the Platform, Customers may apply for loans subject to eligibility criteria determined by the Lender.
Cashfund India acts as a facilitator and service provider authorized by the Lender to:
  • collect and verify Customer information,
  • conduct KYC verification,
  • validate documents,
  • assess eligibility,
  • and assist in loan processing.
To use the Services, you may be required to create a User Account and provide Personal Information including:
  • Name
  • Mobile Number
  • Email Address
  • PAN
  • Aadhaar/KYC details
  • Bank account details
  • Salary slips
  • Bank statements
  • Credit information
  • Device and location data
  • Other relevant documents
You confirm that all information provided by you is true, complete, and accurate.
Loan approval, sanction, and disbursal are solely at the discretion of the Lender and subject to applicable laws and policies.
LOCATION TRACKING
By using the Services, you expressly authorize Cashfund India to collect and track your location data for fraud prevention, verification, risk assessment, and recovery purposes.
Location tracking may continue during the loan tenure and until all Outstanding Amounts are fully repaid, even if:
  • the App is deleted,
  • the Services are discontinued,
  • or the User Account is deactivated.
USER RESPONSIBILITIES
You are solely responsible for:
  • maintaining the confidentiality of your account credentials,
  • all activities conducted through your account,
  • repayment of all Outstanding Amounts,
  • ensuring that your device and internet connectivity are compatible with the Platform.
Uninstalling the App or discontinuing Services does not release you from repayment obligations.
LICENSE TO USE THE APP
Cashfund India grants you a limited, non-exclusive, non-transferable, revocable license to:
  • download,
  • install,
  • access,
  • and use the App for personal and lawful purposes only.
The App is licensed and not sold to you.
RESTRICTIONS
You agree not to:
  • engage in fraudulent or illegal activities,
  • misuse the Platform,
  • upload harmful, defamatory, obscene, or unlawful content,
  • attempt unauthorized access to systems,
  • distribute malware or viruses,
  • infringe intellectual property rights,
  • send spam or unauthorized promotions,
  • interfere with Platform operations.
Violation of these Terms may result in suspension or termination of Services and legal action.
CONTENT DISCLAIMER
Cashfund India does not guarantee the accuracy, completeness, or reliability of any content available on the Platform.
Any reliance on information provided through the Platform shall be at your own risk.
INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights related to the Platform, including:
  • logos,
  • trademarks,
  • software,
  • designs,
  • content,
  • and branding,
are the exclusive property of Cashfund India or its licensors.
No rights are transferred to Users except for limited usage rights granted under these Terms.
THIRD-PARTY LINKS & SERVICES
The Platform may contain links to third-party websites, advertisements, or services.
Cashfund India is not responsible for:
  • third-party content,
  • privacy policies,
  • services,
  • transactions,
  • or any losses arising from interactions with third parties.
ANCILLARY SERVICES
The Platform may offer additional features such as:
  • blogs,
  • reviews,
  • chat features,
  • feedback systems,
  • promotional campaigns.
Users shall not misuse such features for unlawful, abusive, defamatory, or harmful activities.
TERMINATION
Cashfund India may suspend or terminate access to the Platform:
  • for breach of these Terms,
  • due to legal requirements,
  • for fraud detection,
  • for non-payment,
  • or at its sole discretion.
Upon termination:
  • your access rights shall cease immediately,
  • all Outstanding Amounts shall remain payable.
DISCLAIMER OF WARRANTIES
The Platform and Services are provided on an “AS IS” and “AS AVAILABLE” basis.
Cashfund India does not provide any warranties regarding:
  • uninterrupted access,
  • accuracy,
  • suitability,
  • security,
  • reliability,
  • or fitness for a particular purpose.
Use of the Platform is entirely at your own risk.
INDEMNITY
You agree to indemnify and hold harmless Cashfund India, its directors, employees, affiliates, agents, and partners against any claims, damages, liabilities, costs, or expenses arising from:
  • your violation of these Terms,
  • misuse of Services,
  • breach of applicable laws,
  • or infringement of third-party rights.
LIMITATION OF LIABILITY
Cashfund India shall not be liable for any:
  • indirect,
  • incidental,
  • consequential,
  • punitive,
  • or special damages,
including loss of profits, data, goodwill, or business interruption arising from use of the Platform or Services.
FORCE MAJEURE
Cashfund India shall not be liable for delays or failures caused by events beyond reasonable control including:
  • natural disasters,
  • internet failures,
  • system outages,
  • government restrictions,
  • RBI regulations,
  • civil disturbances,
  • power failures,
  • floods,
  • pandemics,
  • or technical disruptions.
CANCELLATION & REFUND POLICY
Pre-Disbursement Cancellation
Customers may cancel a loan application before disbursement.
Post-Disbursement Cancellation
If cancellation is requested within 24 hours of disbursement, the principal amount must be repaid.
Refund of Excess Payments
Any excess payment made by the Customer shall be refunded within 5–7 working days after reconciliation.
PRIVACY POLICY
Collection, storage, use, and sharing of Personal Information shall be governed by the Privacy Policy of Cashfund India available on the Platform.
MODIFICATION OF TERMS
Cashfund India reserves the right to modify these Terms at any time.
Updated Terms shall become effective immediately upon publication on the Platform. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India.
Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
MISCELLANEOUS
Entire Agreement
These Terms, Privacy Policy, Loan Agreement, and related documents constitute the entire agreement between the User and Cashfund India.
Waiver
Failure to enforce any provision shall not constitute waiver of rights.
Severability
If any provision is held invalid or unenforceable, remaining provisions shall continue in full force.
REFERRAL PROGRAM
Cashfund India may offer referral rewards and promotional benefits to eligible users.
Referral benefits:
  • may vary from time to time,
  • are non-transferable,
  • and are subject to verification and eligibility.
Cashfund India reserves the right to:
  • modify,
  • suspend,
  • cancel,
  • or withdraw any referral program without prior notice.
Creation of fake or multiple accounts for misuse of referral benefits is strictly prohibited.

ACCEPTANCE
By accessing or using the Platform and Services, you confirm that:
  • you have read and understood these Terms & Conditions,
  • you agree to comply with them,
  • and you are legally competent to enter into this Agreement.
